I have spoken to Julien and he is very disappointed as to what went down. As you know he is the largest shareholder so his pain and loses are extremely high.
He does have the right to take legal action in the future if he so chooses to do so.
The real problem that bothers him the most was the former board members that were there until May 2014. He feels just like all of us that we were all sold a bill of goods. You know in his opinion the former board destroyed the value of the company with there outrageous lifestyle.
Now this is my opinion Julien was our savior but it was to little to late, I have been in contact with him and got to know him and let me tell you this HE IS A CLASS ACT. He is a very down to earth person and he would of have our best interest in the company believe me when I tell you that.

Bruiser, just call them and get it started, it costs nothing to start a class action (in the USA) as a plaintiff IF IF the lawyers will take the case.

Julien Balkany separated from Nanes Balkany Partners about Jan 2008. It seem that it was not his money involved. I will contact Law firm to see if they would be interested in class action. I would suggest as many as possible do the same thing. Strength in numbers

The previous board of directors could be the only target. They may not be worth enough NET, to validate any suit. The 5% stake Julien Balkany controls is what it will take to validate any class action. Lawyers want to know if there is any BLOOD to suck up with a suit. I hope something can be done, let us know what the attorney has to say after your discussion. Thanks in advance

Would any suit have to meet the claim deadline they noted? I think it was May 7th?

Not for nothing but what could we possibly get if there was anything left we would have gotten something. Believe I'm not negative but the only ones who will make out are the lawyers. I guess we still haven't heard the grand finally until that time nothing can be done. If we can make it HARD and Costly for the PRICKS that ruin this company I'm all for that

I emailed the attorney and she emailed back and wants to talk. She will call Sat morning. I also own a "lot" of stock in another company they are going after and I told her so. I hope her efforts are not for that reason, but I threw it their to create interest. I will relay what happens. They might want blood but so do I. I made the mistake but I feel misled

Can a Canadian get in on the class action or is it only for the American Gasfrac entity? I've never been involved in a class action so I don't know what is what... I lost a chunk of change on this as well. Thanks

I will talk to him and relay the message. I told you his thoughts are just like all of us he got blind sided and he is pissed as we all are. Personally I don't think he will and I don't blame him if he didn't I wouldn't if I was in his position. He would get bombarded with questions that he probably can't talk about. I will relay anything that can be relayed at this point. He is a friend and I don't want to put him in the middle. Hope everyone understands. He had nothing to do with this downfall and if anyone can salvage anything for us it will be him.

Spoke with Julien said he would have no problem sometime in May or June to have a video-conference where he would take questions from shareholders.
To do it on a chat forum is not the appropriate format.

Please keep pursuing all of this. I am interested too....about 50,000 shares...small compared to most, but a major loss to my life savings, which I really need now in my senior years. Thanks to Julien for being so kind. I look forward to getting to know him too. We have a bit of a kinship that has developed thru this board, albiet a forced one due to the circumstances: a kinship none the less, providing a bit of moral support to each other in these times of loss and sadness. Thank you all for participating and helping ease the pain, even if ever so slightly.

I spoke to the Attorney yesterday about a class action. She wasn't positive or negative. I explained what I could and told her to go on the web site and get the most recent financials 9/30/2014. She mentioned one of the problems was they were in bankruptcy, but she would go thru everything and call me next week. I told her that I thought the deadline was May 7.
